Terms and Rules
Terms of Use, paid services, game rules and cookies, all in one place. Written to be read, not skipped.
This text was written by the PokeXP team and has not yet been through professional legal review. It describes honestly how the site works today, but it does not replace a lawyer.
Introduction
Introduction and acceptance
By creating an account or using the website, the client or any official PokeXP channel, you declare that you have read and accepted this document, which brings together the Terms of Use, the Service Agreement, the Paid Services Terms, the Game Rules and the Cookie Policy. Anyone who does not agree, even in part, should not create an account or make any payment.
PokeXP is a fan project, made without profit, with no link to, sponsorship from or approval by Nintendo, Game Freak, Creatures Inc. or The Pokémon Company. Pokémon and all related brands, names and characters belong to their owners.
Official channels: this website and the profiles announced on it (Discord, Instagram, TikTok, YouTube). Support: adminpokexp@gmail.com. Any other address claiming to speak for PokeXP should be treated as a scam.
If the game and the website ever carry different versions of this document, the one published here, with the date at the top, prevails. Anything about personal data is in the Privacy Policy, a separate document.
Part I — Terms of Use and Service Agreement
Purpose
These terms govern access to and use of PokeXP: the website, the game client and the servers. Basic access is free; optional paid services are described in Part II.
Access is granted on a personal, non-transferable and revocable basis. It does not give the user any ownership right over the game, its systems or its content.
Age and guardians
Minors may play with the knowledge and approval of a parent or guardian, who is responsible for the use of the account and for complying with this document.
Payments may only be made by people over 18, or by minors properly represented or assisted by their guardian. A purchase made by a minor without authorization is the responsibility of whoever allowed the use of the payment method.
The team may ask for proof of age or ownership when in doubt. Until the request is met, the account may stay suspended.
Account and ownership
The website account is the same one used to enter the game. Each account must be created with a real email the user can access, and registration data must be kept correct.
All game content — accounts, characters, creatures, items, currencies and achievements — belongs to PokeXP. The user only receives the right to use it while the account is active and in good standing.
Each account may have up to 5 active characters. Deleted characters can be recovered for 1 hour through the game client; after that, there is no way back.
Account security
Password, email and other credentials are the user's sole responsibility. Use a strong password you do not use anywhere else.
The PokeXP team never asks for your password, recovery code or card data, on any channel and in any situation. Any such request is a scam attempt: do not answer, and tell the team.
Enter the game and the website only through official channels. PokeXP is not responsible for losses caused by fake sites, malicious links, third-party programs or credentials leaked through the user's carelessness.
Virtual items and ownership
Creatures, items, currencies, diamonds, characters and achievements obtained in the game are licensed digital content. They have no real-world monetary value, cannot be converted into money and are not property, an investment or a financial asset.
These elements may be changed, rebalanced, removed or replaced at any time, as game balance requires.
Availability, failures and rollback
PokeXP is under development. There is no guarantee of uninterrupted operation, free of errors or immune to attacks, network outages and third-party failures. Maintenance will be announced when possible; emergency maintenance may happen without notice.
Rollback. After a serious failure, a previous backup may need to be restored. Progress, items and achievements obtained between the backup and the restoration may be lost irreversibly. There is no cash compensation for this; in-game compensation is assessed case by case, at the team's discretion.
Test phases. Servers or periods labelled test, beta or early access exist to validate systems. Everything obtained in them may be erased (wipe) at the end of the phase, without compensation.
Responsible use
Playing for many hours in a row, without breaks, can harm your physical and mental health. Take breaks, mind the lighting and your distance from the screen, and keep a balance with sleep, studies, work and the people around you. If you feel the game is getting in the way of your life, look for support.
Suspension and account deletion
Breaking this document may lead to a warning, mute, removal of whatever was obtained irregularly, temporary suspension or permanent deletion of the account, on the scale described under Penalties.
You may ask to close your account at any time through support. Closing is final and does not refund what was already used. Accounts closed on request are not restored.
Intellectual property
The server and website code, the maps, the texts, the game systems, the visual identity and the original art made by the team belong to the PokeXP project.
Reverse engineering, decompiling, copying, redistributing or creating derived servers from the client or game files is forbidden. Videos, streams and screenshots about PokeXP are welcome, including monetized on the platform where they are published.
By sending suggestions, bug reports or material through the website forms, you authorize the team to use that content to develop and promote the project. Authorship remains yours.
Personal data
PokeXP processes personal data under Brazil's General Data Protection Law (Law 13.709/2018). Which data is collected, why, for how long and with whom it is shared is in the Privacy Policy, which is part of this document.
Requests to access, correct or delete data must be sent to adminpokexp@gmail.com.
Limitation of liability
The service is provided as it stands, with the features that exist at the time of access.
The team is not responsible for: losses from technical failure, rollback or unavailability; account break-ins caused by the user; deals made between players outside the game; content posted by users on community channels. None of this removes the rights the law guarantees to consumers.
Changes to this document
This document may change as the project moves forward. The date of the last review is at the top of the page, and relevant changes are announced on the official channels. Continuing to use the service after a change means accepting it.
Governing law and venue
This document is governed by Brazilian law. Any disputes will be handled in the courts of the user's place of residence, under the Consumer Protection Code.
Part II — Paid Services Terms
What is sold
This part complements the previous one and applies to any purchase made in PokeXP: founder packs, diamonds, VIP time and any other product the website or game store may offer.
Sales are not open yet. While a product's checkout is not active, the buy button appears disabled, and no purchase is promised before there is a way to complete it.
Nature. Everything sold is digital content for use only inside the game. It is not currency, a security, a crypto-asset or a means of payment, cannot be converted into money and cannot be withdrawn or transferred out of the platform.
Support, not advantage. Founder packs support development and cover server, tooling and production costs. What each pack delivers is described on its own page, before any payment.
Payment
Payments are processed by contracted intermediaries — Stripe and EfiPay — who handle processing and the security of financial data. PokeXP does not receive or store card numbers.
Accepted methods, amounts and currency are the ones shown on the payment screen at the time of purchase. The purchase must be made by the holder of the payment method. Purchases made by third parties may be blocked until ownership is proven.
Delivery
Paid products are contracted in advance and released on the account after the intermediary confirms the payment. If the payment is not confirmed, nothing is released.
Right of withdrawal
Under article 49 of the Brazilian Consumer Protection Code, you may withdraw from the purchase within 7 (seven) calendar days of ordering, with a full refund.
The right applies to what has not been used yet. It does not apply to diamonds already spent, nor to VIP already activated or items already delivered and used, because by then the digital content has been enjoyed.
The request must be made through support, with the account, the date and the proof of purchase. The refund is made through the same payment method, within 7 (seven) calendar days after the cancellation is confirmed; how long it takes to show on your statement or account depends on the financial institution.
Refunds, reversals and chargebacks
Outside the right of withdrawal, amounts paid are not refundable, except for cases provided by law and proven failures in delivering the product.
Suspension or deletion of an account for breaking this document, and voluntary closing of the account, do not generate a refund of what was already bought.
Chargeback. Disputing a payment with your bank suspends the account and what was bought until the intermediary finishes its review. If fraud or misuse of a payment method is confirmed, the account and accounts linked to it may be permanently deleted.
Inactivity
Accounts with no access for 24 (twenty-four) consecutive months and no active VIP may be closed. Character names from closed accounts may be released to new users after 180 days.
Prices and promotions
Prices, packs and benefits may change at any time; a change applies to future purchases and does not affect what was already acquired. Promotions have their own period and conditions and may end early.
Game balance and the prices of items sold inside the game may also be adjusted, without creating a right to compensation.
Part III — Game Rules
Names
These apply to account, character and guild names and to Pokémon nicknames.
Names that imitate the team. Using names that suggest authority or an official link to PokeXP, such as variations of “GM”, “Admin”, “Support”, “Staff”, “Moderator” or “PKX”, is forbidden. The name is changed on the spot; repeat offenses lead to a ban.
Offensive names. Profanity, hate speech, racism, sexism, homophobia, sexual content and references to drugs or criminals are not allowed.
Inappropriate names. Meaningless names, names with repeated characters, sentences, ads for brands or other servers, or names that do not fit the game universe will be changed by the team.
Names that advertise irregularity. Names like “Selling Account” or “Bot Master” are changed and may lead to extra punishment. The naming rules apply to guilds in the same way.
Cheating and game integrity
Bug abuse. Exploiting flaws for an advantage is forbidden. Found a bug? Report it right away. Anyone who exploits it loses the progress and items obtained and may be banned.
Spreading bugs. Teaching, showing or spreading flaws in videos, streams, social media or messages before they are fixed is also forbidden, even with the intention of warning others.
Multiclient. Playing with more than one character at the same time, both performing actions — walking, using items or spells, healing Pokémon — to gain an advantage in hunts, bosses, events or quests, is forbidden. Using two characters in a complementary way to maximize hunting is also forbidden.
Unauthorized programs. Bots, macros, scripts, hacks and any tool that automates or modifies the game are forbidden, including macros recorded on a mouse, keyboard or programmable peripheral. The ban is immediate.
Detection can be retroactive. The account may be punished months later, based on analysis of logs and patterns. Detection methods are confidential and not detailed.
Extra accounts for rewards. Using secondary accounts to accumulate rewards from events, giveaways, codes or referrals is forbidden. Scams and impersonation: posing as the team, another player or a game system, and any attempt to get accounts, data or items from others by deception, is punished with a permanent ban.
Aiding violations. Helping, encouraging or taking part in cheating counts as doing it yourself, and knowing about a serious irregularity and not reporting it can also be punished.
Anti-game conduct. Blocking respawns, trapping players, locking NPCs or chasing beginners with the intent to hinder them is punishable. Not irregular: attacking a Pokémon another player is already attacking, hunting at the same respawn as another player and luring wild Pokémon, as long as there is no intent to harass.
Checks. The team may run checks at any time. Trying to avoid, delay or hinder a check may lead to a ban.
Trading and account sharing
Allowed: trading and selling items and Pokémon between players inside the game; sharing an account, under the full responsibility of the holder.
Not allowed: advertising the sale of items, accounts or characters for real money on official channels (game chats, Discord, website or the project's social media); reselling or transferring Part II products outside its conditions; simulating trades, leaving items on the ground as a way of transfer or setting token prices to hide irregular trading.
Responsibility. PokeXP is not responsible for deals made outside the game. Theft, scams, and loss of items or accounts in those deals are the responsibility of the players involved and generate no return or restoration. The same goes for sharing an account: password, email and access belong to the holder, and accounts taken over by whoever received access are not restored.
Messages and behavior
Offensive messages. Harassment, racism, sexism, homophobia, hate speech, threats and praising crimes are not tolerated and lead to a mute or a ban.
Personal data and stalking. Sharing or asking for personal data of other players or the team (address, phone, documents, bank data, social media, screenshots of private chats) and stalking, intimidating or trying to identify someone outside the game is forbidden. Punishment: permanent ban.
Advertising and spam. Advertising other servers, products or services, sharing invites and outside groups, repeating messages or flooding the chat with special characters is forbidden on public channels.
Right channels. Questions go to the help channel; buying, selling, trading and team forming go to the trade chat; announcements of streams, groups and guild recruitment do not go in general chat. Use each channel's language.
Criticism of the team. Complaints about the team must go through support, not public channels.
Respect and community
The idea is not to build a punitive environment, but to keep a basic level of respect and camaraderie.
Mutual respect: treat everyone politely. Language: avoid profanity and aggression. Kindness: help beginners. Arguments: debating is normal, fighting is not. Organization: keep each topic in the right channel.
Support and reports
Reports must be made through the official support channels, with as much detail as possible: character name, date, time and evidence. Do not demand punishment of other players in public chats; the team does not disclose the outcome of individual reports. False accusations and mass reports made in bad faith are also punishable.
Team conduct. Administrators, moderators and other collaborators follow every rule in this document, without exception, plus the rules of the role. No team member may ask for a password, recovery code or payment data, or use the role to gain an advantage in the game, create items, change progress or leak update information early.
Penalties
Punishments follow the seriousness and history of the player and may be applied separately or together: warning; name change; mute, temporary or permanent; removal of progress, items or currency obtained irregularly; temporary ban; permanent ban of the account and the Discord.
Repeat offenses make the punishment worse. In serious cases — unauthorized programs, scams, identity fraud, stalking or systematic bug abuse — a permanent ban may come the very first time.
When there is a proven technical link between accounts (same IP, same device, transfers between them), the punishment may extend to the related accounts. A ban does not generate a refund.
Decisions
Punishments are applied at the team's discretion, based on the server's records, with no need for prior notice. The records and methods used in the investigation are confidential. The team's decision is final, and insisting on the same matter after the answer may lead to extra punishment.
Part IV — Cookie Policy
Cookie policy
Cookies are small files the website saves in your browser to recognize you on later visits. Similar technologies, such as local storage, are treated the same way here.
PokeXP only uses essential cookies. “pkx-sessao” keeps you signed in (7 days); “pkx-locale” remembers your language (1 year); “pkx-convite” stores for up to 30 days the code of a creator's link, only if you opened one, and is deleted when the account is created. We do not use advertising cookies, cross-site tracking or audience analytics tools.
That is why there is no cookie consent banner: there is no optional cookie to accept. If this changes, this part changes with it, and the notice will exist before any non-essential cookie is activated.
You can block or delete cookies in your browser settings (Chrome, Firefox, Safari, Edge), but blocking the essential ones prevents sign-in. At checkout, the intermediaries — Stripe and EfiPay — may set their own cookies, needed for the transaction and fraud prevention; they handle that data under their own policies.
Final provisions
Final provisions
This document applies to all users, including the team and partners. If it conflicts with something said verbally, on social media or by a team member, what is published here prevails.
The team may act on conduct that harms the community or the integrity of the game even if it is not literally described here. Occasional tolerance of irregular conduct is not authorization, precedent or an acquired right. If a clause is found invalid, the others stay in force.
The goal of these rules is a fair, safe and fun experience for everyone. Play clean, respect others and enjoy the adventure.
